Description:
This course focuses on the analysis of the legal grounds for malpractice litigation and professional responsibilities in four critical areas of social work/mental health practice. We will outline standard of care and negligence issues in Suicide Risk Management, clinicians and agencies' duties to protect clients and others as part of Violence Risk Mitigation, the nature and the legal hazards of dual and multiple relationships in professional settings relating to Boundary Issues, and the legal basis of slander and libel claims related to Defamation of Clients and Others through improper documentations and comments.

Objective:

1. Apply the legal principles underlining professional liability in social work and mental Health Practice.

2. Discuss and analyze the standard of care in working with clients at risk for suicide and violence.

3. Explain and assess the personal and professional liability risk from failure in protecting supervisees,colleagues and employees in relationship to potential violent clients.

4.Identify and Assess issue of interpersonal boundaries and how they might create risk of professional liability and ethical quandaries.

5. Discuss and explain the risk of defaming clients and third parties in the course of mental health/social work practice through clinical documentation and testimonies.

6. Explain, assess and manage professional liability risk from negligence and misconduct of supervisees and employees.

7. Formulate and develop appropriate policies and procedures to minimize liability risks and insure high quality of care.
